A Georgia driver incriminated himself at his crash site when he continued sipping a cocktail in front of the responding police officer, an affidavit says.

The crash happened just before 11 p.m. on Monday, Feb. 24, in Duluth, when the man didn’t stop for a red light, the Duluth Police Department wrote in an affidavit.

“Our Real-Time Crime Center captured the moment he sped through an intersection, causing a crash that sent him to the hospital with a head injury,” police wrote in a March 8 Facebook post.

“To make matters worse? He was still drinking when officers arrived.”

That drink was a BuzzBallz, a brand of canned cocktails, and the driver was seen “finishing one of the alcoholic beverages” as the responding officer stood watching, an affidavit reports.

Three empty BuzzBallz were found in the vehicle, police said.

The driver was hospitalized for treatment of a “serious head injury,” then charged with driving under the influence of alcohol, having an open container of alcohol and failure to obey a traffic control device, police said.

The condition of the other driver was not revealed.

Duluth is about a 30-mile drive northeast from Atlanta.
